Selling "AS-IS"

The term “as-is” is regularly used in a purchase and sale agreement to indicate that the seller makes no warranties or representations about the property’s condition. It is intended to relieve the seller from liability for failing to disclose a material defect in the property that is not known to the buyer. Hence, the effect of an “as is” provision for the sale of the real property is that the buyer accepts the property in the condition that is visible or observable by him. Shapiro v. Hu, (1986) 188 Cal. App. 3d 324; Katz v. Department of Real Estate, (1979) 96 Cal. App. 3d 895, 901

In other words, selling your property or home "AS-IS" can be sold in its current condition without having to make any repairs, improvements or offer any credit unless agreed upon. The Buyer can accept the home with existing issues ranging from structural to cosmetic. 

In the State of California, it is required for the Seller to disclose any facts that materially affect the value or desirability of the property which the buyer may not be able to observe at that time of inspection. These disclosures required by law usually cannot be waived. Selling "As-Is" protects the Seller when the Buyer observes defects but buys the property anyways accepting the defects.

Some examples of defects on the property that must be disclosed if known include, but are not limited to:

● Mold

● Structural defects

● Issues with the foundation

● Harmful chemicals

● Asbestos

● Faulty roof​

 

 

Physical inspections (done by independent inspector not by the city)  May take up to 3 hours, during which they will check everything, including but not limited to:

  • Plumbing

    • Toilets, faucets , water pressure, etc  

  • Electrical

    • All outlets, switches, lights, electrical panels, etc

  • Drain lines

    • Sewer lines, kitchen and bathroom drains, etc

  • Roof

    • Wear, age, when it is installed, how many layers are exsisting, most cities only allow 2 layers and then the roof need to be replaced, etc

  • Peeling paint

    • Lead, abestos
